The International Emergency Economic Powers Act (IEEPA) was used to impose broad tariffs on imports starting February 4, 2025. On February 20, 2026, the U.S. Supreme Court ruled 6-3 that IEEPA does not authorize the President to impose tariffs. CBP stopped collecting IEEPA duties on February 24, 2026 and is now building a refund system called CAPE to return approximately $166 billion in duties paid by over 330,000 importers of record โ€” plus 6% annual interest.
You likely qualify if: (1) your company was the official Importer of Record on CBP entry summaries during the covered period, (2) you paid IEEPA tariff add-ons (Chapter 99 HTS codes) on those entries, and (3) your imports occurred between February 4, 2025 and February 24, 2026. This includes "fentanyl" tariffs on Canada, Mexico, and China from February 4, 2025, and reciprocal tariffs on most other countries from April 2, 2025. Section 301 China tariffs, Section 232 steel/aluminum duties, and AD/CVD duties are not covered โ€” those remain in force under separate authority.
Recovery depends on your import volume, the countries you imported from, the HTS codes involved, and the IEEPA rates applied to your entries. As of late March 2026, CBP reported the portal is 40-80% complete across its four functional areas. The target launch is approximately April 20, 2026. When CBP "liquidates" (finalizes) a customs entry, a 180-day clock starts.
